These Terms of Use and Sale apply to your use of the Pantheone Audio website, your purchase of Pantheone products, and your use of Pantheone products, software, applications and connected services.
This website is owned and operated by Pantheone Pty Ltd, trading as Pantheone Audio. By accessing our website, placing an order, or using our products or connected services, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable consumer protection law.
About Pantheone
Pantheone Audio designs and sells sculptural sound objects and connected audio products. Our products may include physical hardware, software, firmware, mobile applications, wireless connectivity, voice assistant features, streaming integrations and third-party technology services.

Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, products, website, technology, legal obligations or customer experience.
The version published on our website at the time of your use or purchase will apply. We will make reasonable efforts to notify customers of significant changes where appropriate.
Website content
We take reasonable care in preparing and maintaining the information on our website. However, product information, images, availability, specifications, pricing and other content may change from time to time.
To the extent permitted by law, Pantheone does not guarantee that all website content will always be accurate, complete, current or free from technical or typographical errors.
Product images are provided for guidance. Colours, finishes and textures may appear differently depending on lighting, screen settings, photography and natural material variations.
Handcrafted products and natural variations
Pantheone products are designed as sculptural sound objects and may include hand-finished or handcrafted details. Slight variations in finish, tone, surface, texture, colour or other visual details may occur.
These variations are part of the nature of the product and do not necessarily indicate a fault, defect or manufacturing issue.
Eligibility to purchase
You must be at least 18 years old to place an order on our website.
By placing an order, you confirm that the information you provide is accurate, complete and current.
Orders and acceptance
When you place an order, you will receive an order confirmation. This confirmation does not necessarily mean that your order has been accepted.
We reserve the right to review, verify, refuse or cancel an order where we reasonably believe there may be an error, fraud risk, payment issue, stock issue, pricing error, shipping restriction, or other legitimate reason.
If we cancel an order after payment has been taken, we will refund the amount paid, subject to these Terms and any rights you may have under the Australian Consumer Law.
Pricing, payment and taxes
Prices are displayed in the currency shown on the website at the time of purchase.
Prices may include or exclude taxes depending on your location, the relevant market settings, and applicable laws. Any shipping charges, duties, taxes or other charges will be shown where applicable during checkout, or otherwise explained before or after purchase where required.
We may update prices, promotions and offers at any time without notice. Price changes do not apply to orders already accepted, unless there has been an obvious pricing or system error.
Payment processing
Payments are processed through third-party payment providers. Pantheone does not store full credit card details on its own servers.
Where a customer voluntarily cancels an order after payment has been processed, Pantheone may deduct any non-refundable payment processing fees from the refund, where permitted by law.
This deduction does not apply where a refund is required because of a faulty product, damaged product, incorrect product, or any right under the Australian Consumer Law or other applicable consumer protection law.
Promotions, discounts and offers
From time to time, Pantheone may offer promotional codes, discounts, bundles, gifts, free shipping or other offers.
Promotions are subject to the terms stated at the time of the offer. Unless otherwise stated, promotions cannot be combined, exchanged for cash, applied retrospectively, or used after expiry.
Pantheone may correct, cancel or refuse a promotion where there has been an obvious error, misuse, suspected fraud, or breach of the offer terms.
Shipping and delivery
Pantheone ships products to selected locations in Australia and internationally.
Delivery timeframes are estimates only and may be affected by courier delays, customs processing, public holidays, weather, incorrect delivery details, remote locations or circumstances outside our reasonable control.
Pantheone is not responsible for delays caused by third-party couriers, customs authorities, government agencies, incorrect customer information, or events outside our reasonable control.
If a product is lost or damaged in transit before delivery to you, please contact us as soon as possible so we can investigate with the courier and assist with a suitable resolution.
International orders, customs and duties
For international orders, import duties, taxes, customs charges, clearance processes and delivery requirements may vary depending on the destination country.
Where Pantheone offers delivery terms that include duties and taxes, this will be stated at checkout or in writing. Otherwise, customers may be responsible for any applicable customs duties, taxes, import charges or clearance requirements in their country.
Pantheone is not responsible for delays caused by customs inspections, customs clearance, local tax authorities, import restrictions or local delivery procedures.
Pantheone App and connected services
Some Pantheone products may use or rely on the Pantheone App, firmware, software, Wi-Fi, Bluetooth, streaming platforms, app stores, cloud services, operating systems, voice assistants, third-party integrations, third-party servers and other technology providers.
While we make reasonable efforts to support the continued operation of the Pantheone App and connected features, we do not guarantee that the App, connected services, integrations, streaming features, voice-control features or software-based functions will always be available, uninterrupted, error-free, or compatible with every device, router, network, operating system, app store, streaming service or third-party platform.
Pantheone is not responsible for interruptions, delays, limitations, incompatibility, loss of functionality or changes caused by third-party services, app stores, operating systems, streaming platforms, network providers, cloud providers, voice assistants, firmware providers, software updates or other circumstances outside Pantheone’s reasonable control.
We may update, modify, suspend or discontinue app-based features, firmware, integrations or connected services from time to time where required for security, technical, operational, legal or third-party platform reasons.
Nothing in this section excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable consumer protection law.
Product compatibility
Pantheone products may require compatible devices, networks, software, firmware, app versions, streaming accounts or third-party services to access certain features.
Customers are responsible for ensuring they have suitable internet access, Wi-Fi, mobile devices, operating systems, streaming accounts, routers, cables or other equipment required to use specific features.
Pantheone is not responsible for issues caused by customer networks, internet providers, incompatible devices, third-party account restrictions, streaming service changes, router settings or local environment conditions.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Change-of-mind returns
Please choose carefully. Pantheone does not generally offer refunds for change-of-mind purchases.
Change-of-mind returns may be accepted at Pantheone’s discretion, subject to the following conditions:
• The product must be unopened, unused and in original, undamaged packaging.
• All accessories, manuals, documentation and packaging must be included.
• You must contact Pantheone within 7 days of receiving the product.
• You must receive written return approval from Pantheone before sending the product back.
• You are responsible for return shipping costs for change-of-mind returns.
• The product must be returned using a reliable tracked shipping service.
• Pantheone is not responsible for products lost or damaged during customer-arranged return shipping.
Once the returned product is received and inspected, any approved refund will be processed to the original payment method.
Nothing in this section affects your rights under the Australian Consumer Law.
Faulty, damaged or incorrect products
If your product arrives faulty, damaged, incorrect or not as described, please contact Pantheone as soon as possible with your order details, photos, videos where relevant, and a description of the issue.
Where a product is confirmed to be faulty, damaged in transit, incorrect, or otherwise covered by the Australian Consumer Law, Pantheone will provide a remedy as required by law. This may include repair, replacement, refund or another appropriate remedy depending on the circumstances.
Pantheone will cover reasonable return shipping costs where required by law or where we confirm the issue is covered by warranty or the Australian Consumer Law.
Return process
To request a return, repair, replacement or refund, please contact our customer support team with:
• Your full name
• Order number
• Proof of purchase
• Product serial number
• A description of the issue
• Photos or videos, where relevant
Please wait for written return instructions from Pantheone before sending any product back.
Products must be securely packaged for return. Where the product is being returned because of a fault, damage or warranty issue, Pantheone may provide instructions or arrange the most appropriate return method.
Limited warranty
Pantheone provides a 24-month limited warranty from the date of purchase to the original retail purchaser.
This warranty covers defects in materials and workmanship under normal use, subject to the terms below.
If a product is confirmed to have a defect covered by this warranty, Pantheone may repair the product, replace the product, or provide another remedy as required by law.
If the original product model is no longer available and cannot reasonably be repaired or replaced with the same model, Pantheone may replace it with a current model of equal or greater value where appropriate.
The benefits provided by this warranty are in addition to, and do not limit, any rights or remedies you may have under the Australian Consumer Law.
Warranty exclusions
To the extent permitted by law, the limited warranty does not cover:
• Damage caused by misuse, abuse, neglect, accident or mishandling
• Improper installation, setup, storage or operation
• Use not in accordance with Pantheone’s instructions
• Normal wear and tear
• Environmental deterioration or exposure to unsuitable conditions
• Cosmetic damage that does not affect product functionality
• Damage caused by unauthorised repairs, modifications or tampering
• Damage caused by power surges, unstable electricity supply or unsuitable power sources
• Damage caused by third-party accessories or equipment
• Issues caused by customer Wi-Fi, internet, routers, devices or third-party services
• Products with altered, removed or missing serial numbers
• Products not purchased from Pantheone
• Products transferred, resold or supplied to another party, except where applicable law provides otherwise
Nothing in this section excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
Repairs and servicing
If your product requires repair or assessment, please contact Pantheone before returning the product.
Pantheone will assess the product and advise the next steps within a reasonable time. Timeframes may vary depending on fault diagnosis, parts availability, shipping, location and service requirements.
Where a product issue is not covered by warranty or the Australian Consumer Law, Pantheone may provide an estimate for assessment, labour, parts, freight or service charges before proceeding.
Where no fault is found, and where permitted by law, you may be responsible for reasonable assessment or return shipping costs.
Third-party links and content
Our website may include links to third-party websites, platforms, advertisements or services.
These links are provided for convenience only. Pantheone does not control, endorse or accept responsibility for third-party websites, platforms, content, products, services, policies or practices.
Intellectual property
All content on the Pantheone website, including text, images, photography, video, design, layout, graphics, logos, product names, product designs, trademarks, trade names, copy, artwork and other materials, is owned by or licensed to Pantheone.
You must not copy, reproduce, publish, distribute, modify, upload, transmit, sell or use any Pantheone content for commercial purposes without Pantheone’s prior written consent.
Pantheone reserves all rights in its intellectual property.
Trademarks and third-party marks
Pantheone, Pantheone Audio, Pantheone I, Obsidian and related names, logos and product identifiers are trademarks or brand assets of Pantheone.
Third-party names and marks, including Apple, AirPlay, Amazon, Alexa, Spotify, TIDAL, Bluetooth, Wi-Fi, Google, Android and other marks, belong to their respective owners. Their appearance on our website does not imply endorsement, sponsorship or partnership unless expressly stated.
Limitation of liability
To the maximum extent permitted by law, Pantheone is not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, loss of goodwill, business interruption or other similar loss arising from your use of the website, products, app, software, connected services or third-party services.
Where the law implies a guarantee, condition or warranty that cannot lawfully be excluded, Pantheone’s liability is limited to the extent permitted by law.
Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under the Australian Consumer Law or other applicable law.

Your use of our website, products, app and services may involve the collection and handling of personal information.

Governing law
These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
